7.2 If Zhongke CloudPlant suffers losses (including but not limited to direct losses, attorney fees, litigation fees, etc.) due to the user's violation of this Notice or relevant rules, the user shall compensate in full.

VIII. Applicable Law and Jurisdiction

8.1 The conclusion, validity, interpretation, performance, and dispute resolution of this Notice shall be governed by the laws of the People's Republic of China (excluding conflict of law rules).

8.2 Any dispute between the user and Zhongke CloudPlant arising from this Notice shall first be resolved through friendly negotiation; if negotiation fails, either party has the right to file a lawsuit with a people's court with jurisdiction at the place where Zhongke CloudPlant is located.

8.3 During the dispute resolution period, except for matters in dispute, both parties shall continue to perform other terms of this Notice.

IX. Amendment and Effectiveness of the Notice

9.1 Zhongke CloudPlant may modify this Notice according to changes in laws and regulations, business development, etc. After modification, it will be publicized through website announcements, pop-ups, etc., and will take effect after the publicity period expires.

9.2 If the user has objections to the modified Notice, they shall stop visiting and using this website; continued use of the website indicates acceptance of the modified Notice.

9.3 This Notice becomes effective from the date of publication and replaces the relevant legal notices previously published.

X. Supplementary Provisions

10.1 The headings of this Notice are for convenience of reading only and do not affect the interpretation and validity of the terms.

User Service Agreement

I. Scope of Agreement and Definitions

1.1 This Agreement is a legally binding contract entered into between you (an individual or entity, hereinafter referred to as the "User") and Zhongke CloudPlant (Zhejiang) Electronic Information Technology Institute (hereinafter referred to as "Zhongke CloudPlant", "we") regarding your use of cloud computing equipment, software and hardware products, technical services, network services, and other related services (hereinafter collectively referred to as "Services") provided by Zhongke CloudPlant.

1.2 By clicking "Agree", "Accept" on a web page or actually using the Service, you indicate that you have read the entire Agreement, fully understood, and agreed to accept all terms of this Agreement and its附属 rules such as the "Privacy Policy" and "Cookie Policy". If you do not agree to this Agreement or relevant附属 rules, do not use the Service.

1.3 The 附属 rules of this Agreement include but are not limited to the "Privacy Policy", "Cookie Policy", special instructions on service opening pages, product manuals, and official website announcements of Zhongke CloudPlant. They have equal legal validity with this Agreement. If there is a conflict between 附属 rules and this Agreement, the specific rules shall prevail; if there are no specific rules, the provisions of this Agreement shall apply.

II. Service Content and Provision

2.1 Scope of Service

  • Cloud computing related services: Including but not limited to cloud servers, cloud storage, cloud databases, leasing of cloud computing resources, and related technical support;
  • Software and hardware product services: Including but not limited to sales, installation, debugging, maintenance of electronic information equipment, and related technical services;
  • Customized technical services: Including but not limited to technical development, system integration, and solution provision based on user needs;
  • Other services: Other legal services clearly notified by Zhongke CloudPlant through the official website or product pages.

2.2 Service Delivery Method

  • Online services: Remote services provided through the official website of Zhongke CloudPlant, designated network platforms, or clients;
  • Offline services: On-site services such as installation, debugging, and maintenance provided according to user needs (specifically subject to agreement between both parties);
  • Service standards: Zhongke CloudPlant will provide services in accordance with industry norms, product instructions, and standards agreed by both parties. Users can query service details via the official website or contact customer service for consultation.

2.3 Service Fees

  • Free services: Some basic services provided by Zhongke CloudPlant may be free. Free services can be adjusted or terminated at any time without the need to bear liability for compensation to users;
  • Paid services: The fee standards, payment methods, and billing cycles for paid services are subject to the service opening page, order confirmation information, or written agreement between both parties. Users shall pay fees on time according to the agreement;
  • Fee adjustment: Zhongke CloudPlant may change fee standards according to market changes and cost adjustments. Before the change, users will be notified via official website announcements, station letters, etc. Continued use of the service by the user indicates acceptance of the new fee standards. If the user disagrees, they may stop using the relevant service.

III. Account Management

3.1 Account Registration

  • Users need to register an account through channels designated by Zhongke CloudPlant and provide true, accurate, and complete registration information (including but not limited to name/entity name, contact information, certificate information, etc.) and update registration information in a timely manner to ensure its validity;
  • Users declare and guarantee that the information provided at registration does not violate laws and regulations or infringe upon the legitimate rights and interests of third parties; otherwise, they shall bear all responsibilities arising therefrom;
  • After successful account registration, users shall properly keep account names, passwords, verification codes, and other identity credentials and bear legal responsibility for all actions under the account.

3.2 Account Use and Restrictions

  • The account is for use by the registered user only. Without the written consent of Zhongke CloudPlant, it shall not be lent, rented, transferred, or shared with others; otherwise, Zhongke CloudPlant has the right to suspend or cancel the account;
  • When a user discovers that the account has been stolen, used by others, or has security risks, they shall immediately notify Zhongke CloudPlant and take corresponding measures. Zhongke CloudPlant will assist the user in handling the matter but is not liable for losses caused by the user's failure to notify in time or failure to properly keep the account;
  • Zhongke CloudPlant has the right to adjust login methods and usage permissions of the account according to security risks, compliance requirements, etc., and may require users to perform identity verification when necessary.

3.3 Account Cancellation

  • Users can apply to cancel the account through the designated path on the official website or by contacting customer service. Before cancellation, all unpaid fees must be settled and rights and obligations related to the account (such as unbinding and terminating services) must be handled;
  • After the account is cancelled, Zhongke CloudPlant will stop providing relevant services, but data may be retained according to legal requirements or "Privacy Policy" agreements; the account cannot be recovered after cancellation, so users should proceed with caution.

IV. User Rights and Obligations

4.1 User Rights

  • Have the right to use legal services provided by Zhongke CloudPlant in accordance with this Agreement and relevant agreements;
  • Have the right to know relevant information such as service functions, fees, and rules of use, and may consult Zhongke CloudPlant regarding questions about the service;
  • Have the right to make complaints and suggestions to Zhongke CloudPlant regarding service quality and user experience. Zhongke CloudPlant should respond and handle them in a timely manner;
  • Under the premise of complying with this Agreement and relevant laws and regulations, have the right to choose to use or stop using the Service at their own discretion (for paid services, remaining fees should be handled according to the agreement);
  • Personal information is protected by Zhongke CloudPlant and has the right to require Zhongke CloudPlant to handle personal information in accordance with the "Privacy Policy", including querying, correcting, and deleting;
  • If there are quality problems with the service or it does not meet the agreement, have the right to require Zhongke CloudPlant to take remedial measures (such as repair, replacement, refund, etc.), specifically subject to the agreement between both parties or laws and regulations.

4.2 User Obligations

  • Comply with the laws and regulations of the People's Republic of China and relevant international treaties and practices, and must not use this Service to engage in any illegal or irregular activities, including but not limited to: disseminating illegal information, infringing upon others' intellectual property rights, endangering network security, fraud, gambling, money laundering, etc.;
  • Comply with this Agreement and other rules published by Zhongke CloudPlant, and must not exceed the scope of service or violate usage norms when using this Service;
  • Must not interfere with or destroy the normal operation of this Service, attempt to access servers, databases, source code, and other systems or information of Zhongke CloudPlant without authorization, or perform reverse engineering, decompilation, cracking, etc. on the service;
  • Must not use this Service to infringe upon the legitimate rights and interests of third parties, including but not limited to intellectual property rights, privacy rights, reputation rights, property rights, etc.;
  • Pay service fees according to the agreement. If payment is not made on time, Zhongke CloudPlant has the right to suspend or terminate the service, and the losses caused thereby shall be borne by the user;
  • Bear the relevant fees and risks of equipment, networks, software, etc. required for using this Service by yourself, and ensure your own equipment meets the service usage requirements;
  • Cooperate with compliance checks, security verifications, etc. conducted by Zhongke CloudPlant and provide necessary proof materials or information;
  • Must not use this Service to send spam, harassment information, or engage in acts that affect other users' normal use.

V. Rights and Obligations of Zhongke CloudPlant

5.1 Rights of Zhongke CloudPlant

  • Has the right to change, suspend, or terminate part or all of the services according to technological development, business adjustment, compliance requirements, etc. Before change or termination, users will be notified through reasonable channels such as official website announcements and station letters (except in emergencies);
  • Has the right to formulate and modify this Agreement and relevant service rules. After modification, they will be publicized through official website announcements, etc. Continued use of the service by the user indicates acceptance of the modified rules;
  • Has the right to supervise and inspect the user's usage behavior. If it is found that the user violates this Agreement or laws and regulations, it has the right to take measures such as warning, limiting functions, suspending service, and cancelling the account;
  • Has the right to collect and use relevant information of the user according to service needs, subject to the "Privacy Policy" and "Cookie Policy";
  • Has the right to use suggestions, feedback, and ideas submitted by the user during the use of the service without compensation, without the need for separate user consent;
  • Within the scope permitted by laws and regulations, has the right to adjust and optimize technical parameters and functional designs related to the service without the need to notify users in advance.

5.2 Obligations of Zhongke CloudPlant

  • Provide stable and safe services in accordance with this Agreement and relevant agreements, and make reasonable efforts to ensure the normal operation of the service;
  • Establish a sound data security management system, take necessary technical measures to protect the user's personal information and data security, and prevent information leakage, loss, or tampering;
  • Provide users with after-sales services such as service consultation and complaint handling, and respond to user's reasonable requests in a timely manner;
  • Publicly display relevant information such as service functions, fees, and usage rules to safeguard the user's right to know;
  • Comply with relevant laws and regulations, not use the service to engage in illegal or irregular activities, and not infringe upon the legitimate rights and interests of users and third parties;
  • Keep confidential the user's trade secrets, personal privacy, and other information involved in the service (except for disclosure required by laws and regulations or with user consent).

VI. Intellectual Property Rights

6.1 Intellectual Property Rights of Zhongke CloudPlant

  • The intellectual property rights of the services provided by Zhongke CloudPlant and website content (including but not limited to text, images, icons, logos, software, codes, data, etc.) belong to Zhongke CloudPlant or its licensors and are protected by laws and regulations;
  • Without the written consent of Zhongke CloudPlant, users shall not reproduce, modify, disseminate, display, transfer, or license others to use the aforementioned intellectual property rights, and shall not infringe upon the legitimate rights and interests of Zhongke CloudPlant such as trademark rights, copyrights, and patent rights;
  • Users must not perform reverse engineering, decompilation, cracking, or tampering on software or codes related to the service, nor extract technical information or trade secrets therein.

6.2 User's Intellectual Property Rights

  • The intellectual property rights of content independently created and uploaded by users during the use of the service (such as data, documents, design results, etc.) belong to the user. However, the user grants Zhongke CloudPlant a free, non-exclusive right to use it within the scope of the service for purposes such as providing services and optimizing services;
  • The user guarantees that the content provided does not infringe upon the intellectual property rights of third parties; otherwise, they shall bear the losses caused to Zhongke CloudPlant and third parties thereby. Zhongke CloudPlant has the right to delete relevant content and suspend or terminate the service.

6.3 Third-Party Intellectual Property Rights

  • The service may contain intellectual property rights of third parties (such as third-party software, plug-ins, etc.). The relevant rights belong to the third parties, and users shall comply with the relevant rules of the third parties;
  • Zhongke CloudPlant does not assume responsibility for the legality, integrity, or security of third-party intellectual property rights. If the user has objections to third-party intellectual property rights, they should communicate directly with the third party.

VII. Data Security and Privacy Protection

  • Zhongke CloudPlant will collect, use, store, and protect users' personal information and data in accordance with the "Privacy Policy" and "Cookie Policy", and take technical measures such as encrypted storage, access control, and security audits to prevent data leakage, loss, or tampering;
  • Users are responsible for the security and legality of data stored and transmitted in the service by themselves. Zhongke CloudPlant does not bear losses caused by problems existing in the user data itself or the user's failure to take reasonable security measures;
  • Without the user's consent, Zhongke CloudPlant will not disclose the user's personal information and data to third parties, except where required by laws and regulations or necessary for providing services;
  • After the service is terminated, Zhongke CloudPlant will process the user's data in accordance with legal requirements and the "Privacy Policy" agreement and will not illegally retain or use user data.

VIII. Third-Party Services and Links

  • The service may contain services provided by third parties or links to third-party websites. Zhongke CloudPlant does not assume responsibility for the content, security, or legality of third-party services and websites;
  • Users using third-party services or visiting third-party websites shall comply with the service agreement and privacy policy of the third party. Relevant risks shall be borne by the user themselves;
  • Zhongke CloudPlant provides third-party services or links solely for the convenience of users and does not indicate endorsement of the third party's services or content. If a user has a dispute with a third party, they shall resolve it themselves.

IX. Modification, Suspension and Termination of Services

9.1 Service Modification

  • Zhongke CloudPlant may modify the functions, content, and usage methods of the service according to technological development and business adjustment. Before modification, users will be notified through channels such as official website announcements;
  • If service modification affects the core rights and interests of the user, the user has the right to choose to stop using the service, and Zhongke CloudPlant will refund the remaining fees according to the agreement (if applicable).

9.2 Service Suspension

  • If it is necessary to suspend the service due to technical maintenance, system upgrades, compliance checks, etc., Zhongke CloudPlant will notify users in advance (except in emergencies) and restore the service as soon as possible;
  • If the user violates the agreement, Zhongke CloudPlant has the right to suspend the service until the user corrects the violation;
  • During service suspension, Zhongke CloudPlant does not bear the responsibility for service unavailability, except those caused by intentional or gross negligence of Zhongke CloudPlant.

9.3 Service Termination

  • If the user actively stops using the service, the service terminates from the date when the user completes the operation or notifies Zhongke CloudPlant;
  • If the user violates the agreement and still fails to correct after being warned by Zhongke CloudPlant, Zhongke CloudPlant has the right to terminate the service. The fees already collected will not be refunded, and the losses caused thereby shall be borne by the user;
  • If the user fails to pay service fees according to the agreement, Zhongke CloudPlant has the right to terminate the service until the user settles the fees;
  • If Zhongke CloudPlant terminates the service due to business adjustment, Force Majeure, etc., it will notify users in advance and refund the remaining fees according to the agreement (if applicable);
  • After the service is terminated, the relationship of rights and obligations between both parties terminates, but terms with continuity in this agreement, such as intellectual property, confidentiality, disclaimer, and dispute resolution, remain valid.

X. Disclaimer

  • The service is provided on an "as is" and "as available" basis. Zhongke CloudPlant does not guarantee that the service is flawless or fault-free, nor does it guarantee the continuity, stability, or security of the service. Users use the service at their own risk;
  • Zhongke CloudPlant does not assume responsibility for the accuracy, completeness, or legality of third-party content and data involved in the service. Users bear the risk of relying on such content or data;
  • Zhongke CloudPlant does not assume responsibility for service unavailability or user losses caused by factors beyond Zhongke CloudPlant's control, such as Force Majeure, third-party infringement, user's own reasons, network failures, or equipment failures;
  • Technical support and consultation provided by Zhongke CloudPlant regarding the service are for reference only and do not constitute a guarantee of service results. Users should judge and bear relevant risks themselves;
  • To the extent permitted by law, Zhongke CloudPlant does not assume any indirect, incidental, consequential, or punitive damages (including but not limited to loss of profit, data loss, loss of goodwill, etc.).

XI. Limitation of Liability

  • If the user suffers losses due to intentional or gross negligence of Zhongke CloudPlant, the upper limit of Zhongke CloudPlant's liability for compensation shall not exceed the total amount of fees paid by the user for the relevant service; if the user has not paid fees, the upper limit of liability for compensation shall not exceed RMB 500;
  • If Zhongke CloudPlant suffers losses due to the user's violation of this agreement, the user shall compensate Zhongke CloudPlant for actual losses, including but not limited to direct losses, attorney fees, litigation fees, and other rights protection fees.

XII. Indemnification

  • If the user violates this agreement and causes losses to Zhongke CloudPlant, its affiliates, partners, or third parties, the user shall bear full compensation liability, including but not limited to direct losses, indirect losses, attorney fees, litigation fees, etc.;
  • If Zhongke CloudPlant is claimed by a third party due to the user's violation, it has the right to seek recourse from the user. The user shall cooperate with Zhongke CloudPlant's defense work and shall not settle with the third party without the written consent of Zhongke CloudPlant.

XIII. Dispute Resolution

  • The conclusion, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (excluding conflict of law rules);
  • Any dispute between both parties arising from this Agreement shall first be resolved through friendly negotiation; if negotiation fails, either party has the right to file a lawsuit with a people's court with jurisdiction at the place where Zhongke CloudPlant is located;
  • During dispute resolution, except for matters in dispute, both parties shall continue to perform other terms of this Agreement.

XIV. General Provisions

14.1 Modification and Announcement of Agreement

  • Zhongke CloudPlant may modify this Agreement according to changes in laws and regulations or business development. After modification, it will be publicized through official website announcements, station letters, etc., and will take effect after the publicity period expires;
  • If the user has objections to the modified Agreement, they should stop using the Service; continued use of the Service indicates acceptance of the modified Agreement.

14.2 Entire Agreement

  • This Agreement and 附属 rules such as the "Privacy Policy" and "Cookie Policy" constitute the complete agreement between both parties regarding the Service matters, replacing any previous oral or written agreements between both parties;
  • If any provision of this Agreement is deemed invalid, illegal, or unenforceable, it does not affect the validity of other provisions.

  • Without the written consent of Zhongke CloudPlant, the user may not transfer the rights or obligations under this Agreement;
  • Zhongke CloudPlant may transfer the rights or obligations under this Agreement to an affiliate or assignee without the need for additional notice to the user, but shall ensure that the assignee complies with this Agreement.

14.5 Force Majeure

  • Force Majeure refers to objective circumstances that neither party can foresee, avoid, or overcome, including but not limited to earthquakes, floods, fires, typhoons, wars, policy changes, epidemics, etc.;
  • If one party is unable to perform the obligations of the agreement due to Force Majeure, the party does not need to bear liability for breach of contract but shall notify the other party in time and provide proof materials.

14.6 Waiver

  • Failure or delay by Zhongke CloudPlant to exercise rights under this Agreement does not constitute a waiver of such rights;
  • Zhongke CloudPlant's failure to pursue responsibility for a single breach of contract by the user does not imply a waiver of subsequent breaches.
